Viator Sues Life Partners Inc.According to court records and the local media, Life Partners' contract called for them to pay the premiums for the viator's health insurance as well as the life insurance. But LPI repeatedly threatened to discontinue paying for the health insurance. Philadelphia attorney Jacob Cohn represented the viator pro bono (no charge). The Honorable M. Allan Vogelson ruled on February 17 that New Jersey had jurisdiction over Life Partners--a hotly contested issue. That gave the Court power to protect this viator and any future viators who have troubles caused by viatical companies. Details and descriptions of court hearings are in several news articles on the Web site of AIDS Law Project Pennsylvania. (Note: The policy originally was sold to Life Partners Inc. when the viator was a resident of New Jersey. She has since relocated to Pennsylvania.) Read the transcript of the February 17, 2006 court hearing and the ground-breaking ruling of Judge Vogelson. Read the letter (dated 04/18/06) in which Judge Vogelson notifies the lawyers that LPI must set up a trust that is funded with $837,357.00 for the benefit of Ms. Smith. |
