SEC drops fraud counts against
LaMonda
Federal securities officials
dropped all fraud charges against Clarence Keith LaMonda.
LaMonda agreed to a settlement w ith the U.S. Securities and
Exchange Commission. Without admitting or denying the violations, LaMonda agreed to a fine
of $50,000 for violating broker-dealer registration rules.
The SEC case, which was filed in
U.S. District Court in Orlando, listed 3 fraud charges against LaMonda and his (by
then-defunct) CD Alternatives Inc. with "knowingly or recklessly disseminated
fraudulent marketing materials" in connection with corporate notes they sold from
March 1994 to May 1995.
In the settlement, the SEC gave up its original demand for unspecified monetary penalities
and the surrender by LaMonda and CD Alternatives of $89,000 in "ill-gotten"
commissions from selling the notes. LaMonda and his associates raised more than $4 million
for the California companies that issued these notes.
Despite the agreement, the SEC continued to claim that LaMonda and CD Alternatives acted
as broker-dealers of the corporate notes while not registered to do so.
