Viator Alert: Danger
 

At least one viatical company routinely violates the rights of clients.

They know that most viators won't file formal complaints with their state insurance departments.

They know you don't want to get involved in a legal hassle, that you don't want the stress.

They may not know that many viators phoned these tales of woe to state insurance departments (DOI). But the DOI can't do anything to help you -- or future viators -- unless the complaint is in writing.

If I have written proof, I can help state insurance departments follow up. This is how Life Partners ended up with a cease and desist order from California -- I gave the dept. of insurance the evidence that started their investigation. (Life Partners didn't know this until they saw my website.)

Without something in writing, if the company is licensed I can't refuse to include them on the list of approved viatical companies. It's bad enough that slimy companies get licenses. How can I warn you, if I don't have evidence?

The situation is serious. We need to do more to help you and others who come along in the future. Read the following list . If you experienced any of these violations, contact me by email.

The NO-NO List:

Company phoned many times in one day/week/month

bullet

You agreed to sell your policy to X but Y keeps after you, telling you horror stories about X or promising you more money if you switch

bullet

Company sent you a sales contract to sign before getting your medical and insurance records

bullet

Company sent you a sales contract before making a purchase offer (The company may have claimed that this would get money to you faster.)

bullet

You had mail and/or phone calls from a company to which you never applied

bullet

Company asks you to sign a form waiving your rights to medical confidentiality

bullet

Company asks you to give them an "exclusive" -- promising not to apply to any other viatical company

bullet

Company asks you to grant them (or investors to whom they sell the policy) the right to your financial information

bullet

Company changes its mind and cancels the sale after you sent back closing (transfer) papers and told lower bidders to take a hike.
