Lawsuit against Internet ArchiveOn July 13, 2005 the New York Times reported about a lawsuit filed against the Internet's Way-Back Machine. The journalist, Tom Zeller Jr., described the Internet Archive as created in 1996 to serve as "the institutional memory of the online world, storing snapshots of ever-changing Web sites . . .." The article noted that www.archive.org, a San Francisco-based nonprofit, was used primarily by Internet historians and intellectual property lawyers whose primary goal was to learn "when and how a trademark might have been historically used or violated." The archive also is of extreme importance to lawyers who defend people who are falsely accused of defamation--people like me. This Web site was created in 1998. That was several computers ago. Any pages from old Web sites that were saved on previous versions of Windows are not accessible today. In other words, I have no proof of what I published or did not publish. That would make it easy for any sleazy viatical company to file a lawsuit in which it falsely accuses me of publishing something that never was published. I would not have TRUTH as a defense, because I could not prove truth. Because the Wayback Machine exists, there is proof of old web pages--mine as well as trillions of others. That proof is at Internet Archive). Many pages were saved--for this Web site dating from 1999. That can mean a hassle to find whether or not a particular page ever existed. But the hassle is worthwhile. This is solid evidence. If you own a Web site or if you post messages to chat groups that criticize another person or a business, you could become the victim of someone who wants to silence you.
